It was introduced last week in the House by Representatives Mariannette Miller-Meeks (R-Iowa), John Joyce (R-Pennsylvania), Greg Murphy (R-North Carolina), Jimmy Panetta (D-California), Ami Bera (D-California), Beth Van Duyne (R-Texas), and Kim Schrier (D-Washington).<\/p>\n<p>This initiative comes as enrollment in Medicare Advantage plans continues to rise, with over half of Medicare beneficiaries now enrolled in these plans. However, the program is facing increasing scrutiny due to delays in care and administrative hurdles. Specifically, the bill proposes to:<\/p>\n<ul>\n<li>Require standard prior authorization approvals within 72 hours, expedited decisions within 24 hours, and real-time approvals for low-risk routine services.<\/li>\n<li>Prohibit retroactive denial of coverage once a service is approved, except in cases of fraud or error.<\/li>\n<li>Mandate that Medicare Advantage plans publicly report prior authorization data.<\/li>\n<li>Prevent MA plans from applying stricter medical necessity standards than those imposed by Original Medicare.<\/li>\n<li>Strengthen network adequacy requirements for rehabilitation hospitals and long-term care facilities.<\/li>\n<\/ul>\n<p>&#8220;Americans rightfully have had enough of healthcare bureaucracy, and prior authorization is one of the worst offenders: delaying treatment, increasing costs, and placing paperwork ahead of patients,&#8221; stated Senator Whitehouse in a press release. &#8220;We need to reduce these administrative hurdles so that providers can deliver timely, high-quality care.&#8221;<\/p>\n<p>Representative Miller-Meeks echoed these sentiments, stating, &#8220;For too long, abuse has crept into Medicare Advantage, moving it away from its primary mission of serving America\u2019s seniors. As a physician, I have seen how these practices delay care, create unnecessary barriers, and increase healthcare costs. This bill restores accountability, cracks down on bad actors, and ensures that seniors in Iowa can access the care they need without delay, denial, or bureaucratic interference.&#8221;<\/p>\n<p>The American Health Care Association and the National Center for Assisted Living have praised the introduction of the bill. Clif Porter, president and CEO of AHCA\/NCAL, commented, &#8220;The Medicare Advantage Improvement Act of 2026 represents a significant step towards ensuring that Medicare Advantage fulfills its promise to American seniors. We commend these legislators for developing a better way to allow seniors timely access to care and hold plans accountable.
